Town Board
July 21, 2003
Chairman St.
Thomas called the Town Board meeting of July 21, 2003 to order at approximately
8:08 p.m. with the Pledge of Allegiance recited immediately thereafter.
Present: Chairman St. Thomas, Supervisor Husak,
Supervisor Case, Supervisor Baade, Supervisor Napgezek, Deputy Clerk-Treasurer
Albertz, Highway Superintendent Brown, and Police Chief Roelandts.
Others present: Becky Rofrtiz, Steve Brunner of Ruekert and
Mielke, and Karen Karnel.
Absent: Clerk-Treasurer Lemley.
Minutes
– A motion made by Supervisor Baade and seconded by Supervisor Husak to approve
the minutes, as printed, from the July 7, 2003 Joint Meeting and Town Board
Meeting. The motion carried
unanimously.
Correspondence
– A letter dated July 15, 2003 received in the Clerk’s Office on July 17, 2003
from Becky Kleefisch was read aloud.

Comments from the
Floor – Karen E. Karnel of N60 W34698 Forest Bay
Road appeared before the Town Board to submit a petition for sewer for the area
of California Avenue/Forest Bay Road/Road I.
(See “Exhibit 2”) She
understands that the Town of Oconomowoc is in negotiations with the City of
Oconomowoc for possible Residential Equivalent Connections
that might become available. This is a
petition of interest. She presented the
petition to the Town Board so that is taken into consideration for the R.E.C.s
that would possibly become available.
She is hoping that that area will be considered for sewer.
Old Business

New Business
-
1. The
“Merger of Title” Amendment/Survey from Waukesha County Zoning Code/Shoreland
and Floodland Protection Ordinance cannot be acted upon at this time. Not all of the surveys have been completed
and turned into the Clerk-Treasurer.
2. Steve
Brunner, a Landscape Designer, from Ruekert and Mielke appeared to discuss the
revisions made to both plans, which have been initiated in the last two/three
years. The population figures have been
updated and any information relating to the newly revised Master Land Use
Plan. He stated that when both the
Outdoor Recreation and Bike/Pedestrian Plan are adopted, they would be used as
planning tools in the future. Chairman
St. Thomas informed the Board to take a look at Table IV. A motion made by Supervisor Case and seconded
by Supervisor Husak to adopt the Outdoor Recreation Plan and Bike
Plan/Pedestrian Plan. The motion
carried unanimously.
3. At the last meeting the Town of Oconomowoc
Plan Commission was directed to give a recommendation to the Town Board. At this time, the Town Board doesn’t have a
recommendation. Adopting the Park Plan
indicates that it has all of the things in there that they are talking
about. Not all the facts are in to act
concisely on; the plan is still being revised.
A motion to agree conceptually to consider collaboration with the
Oconomowoc Soccer Association made by Supervisor Napegzek and seconded by
Supervisor Baade. The motion carried
unanimously.
4. A
motion made by Supervisor Husak and seconded by Supervisor Napgezek to grant
the Temporary Easement for the reconstruction of the intersection of C.T.H. “P”
and C.T.H. “K”. The motion carried
unanimously.
5. This
subject was tabled because the State is revising the amendments for Mill Street
Bridge and will be given to Chairman St. Thomas. They have solved all of the problems at the state.
6. The
Waukesha County Zoning changes should not have been on the agenda; therefore,
no action was taken. The Plan
Commission is acting on it tonight and the Board will see what their
recommendations are.
7. Attorney
Chapman read the ordinance. Highway
Superintendent Brown stated that the weight limit signs are already
posted. A motion to adopt an ordinance
to establish special weight limitations for McMahon Road under special
temporary condition pursuant to ss 349.16 Wisconsin Statutes made by Supervisor
Husak and seconded by Supervisor Case.
The motion carried unanimously.
8. A
motion to accept the low bid quoted by the Kuehne Company, Inc. for guardrail
installation on W. Lake Drive and Lake Drive was made by Supervisor Case and
seconded by Supervisor Husak. The
motion carried unanimously.
9. A
motion made by Supervisor Case and seconded by Supervisor Baade to adopt the
final resolution declaring intent to exercise special assessment powers. The motion carried unanimously.
10. A
motion made by Supervisor Husak seconded by Supervisor Case to adopt the
resolution prohibiting parking on Lacy’s Lane.
A situation occurred on Lacy’s Lane when a resident had a private party
and had numerous visitors parking on one side of the road. This only allowed for one lane of traffic to
pass, which would pose to be a serious problem if an emergency vehicle needed
to pass. A neighbor became frustrated and
parked their car so that it completely blocked traffic and no vehicles were allowed
passage. The road right-of-way is 20
feet and the road width is 20.3 feet, which is not sufficient enough for
parking on both sides. For safety
concerns recommend there should be no parking allowed on Lacy’s Lane. The motion carried unanimously
11. Supervisor
Reports – Supervisor Case reported that he had
received as well as the rest of the Board should have a letter from Koepsel’s
at W375 N6843 Pheasant Run discussing the issue of gravel quarrying behind
them. The quarrying operation will be located at the property owned by James
and Catherine Hansen, which is situated next to the subdivision that the
Koepsel’s live in. Koepsel’s had called
the Park and Planning Department at Waukesha County and spoke with Brian
Depies. They thought that it would be a
dynamiting operation. On August 21,
2003 the County will hold a public hearing.
Supervisor Case addressed a letter to them stating that the “quarrying”
process would be peeling off the topsoil, take out 2 feet of clay to line the
silt ponds, put the topsoil back and reseed it. It would not be as devastating as they originally thought.
An
email had just been received addressed to the Town Board regarding the
condition of West Lake Drive on the north side. One of those little cabins there always has lots of trash and two
vehicles jimmied up off the ground with all of the wheels off. Chairman St. Thomas suggested that the Chief
take a look at the situation. The Chief
stated that the car that Supervisor Case is referring to has been up and down
on blocks and it appears that the person is working on the brakes. Last time the Chief checked, it was
licensed. It has been there a long
time.
Another
house in the process of being moved was parked on the property of John Snyder.
That house has been there for two weeks now, as it should have only been there
for two days. According to the Chief
it was to have been moved at 2 a.m. but apparently they needed permits. Chief Roelandts tried to contact Chief
Martin about the situation.
Supervisor
Napgezek stated that OLMD will be having its annual meeting on the 8/25/03, the
4th Monday in August. Chief
Roelandts may receive a call from OLMD to invite the Town of Oconomowoc Police
Department to set up a booth. They plan
to have a workshop prior to the meeting.
The DNR will have a booth set up there.
This would allow for police officers to explain boater’s safety, and
provide some information.
12. Chairman
St. Thomas – Virginia Harris of W380 N5707 N. Lake
Road called Chairman St. Thomas to explain how bad her trees are infested with
gypsy moths. Margaret Dahlquist of N56
W37860 Forest Drive reported of gypsy moths last month. Chairman St. Thomas put a packet together
for the both of them. He also included
information on what the City of Oconomowoc had done. The City should be aware if the Town has an infestation. The City has traps that they put out in the
spring and have been doing so for the last four/five years. So far the problem is not at the level that
requires spraying. The County suggested
to Chairman St. Thomas to start a program next year to set up gypsy moth traps
in the area to see what we have. The
traps don’t get rid of them; they just determine how bad the gypsy moths are. There is also a company called Lied’s that
provides spraying for gypsy moths which is very effective.

- Becky Rofritz appeared in front of the Board to present the certificate of
insurance for the fireworks display for her upcoming marriage to occur on July
26, 2003 at the Golden Mast Island on Okauchee Lake at 9:30 p.m. A motion made by Supervisor Husak seconded
by Supervisor Napgezek to approve the fireworks permit. The motion carried unanimously.
A
motion made by Supervisor Husak and seconded by Supervisor Baade to approve the
bartender licenses as presented. (See
“Exhibit 3”: New- 2, Renewal - 12). The motion carried unanimously.
On
August 4, 2003, the Waukesha County Clerk’s are joining to discuss various
issues such as dog licenses. A motion
made by Supervisor Husak seconded by Supervisor Case to send Deputy
Clerk/Treasurer Albertz to the Waukesha County Clerk’s meeting on August 4,
2003. The motion carried unanimously.
17. A
motion made by Supervisor Napgezek seconded by Supervisor Baade to approve the
checks and vouchers totaling $620,139.15, as printed. (See “Exhibit 4”). The
motion carried unanimously.
18. Other
Business – Nothing
19. At
approximately 8:53 p.m. Supervisor Husak made a motion to adjourn into closed
session pursuant to ss 19.85 (1)(c) “Considering employment, promotion,
compensation, or performance evaluation data of any public employee over which
the governmental body has jurisdiction or exercises responsibility.” (Police Department) The motion seconded by Supervisor
Napgezek. Chairman St. Thomas called
for a roll call vote: Supervisor
Baade-yes, Supervisor Napgezek-yes, Chairman St. Thomas-yes, Supervisor
Husak-yes, and Supervisor Case-yes.
20.
At approximately 9:35 p.m. the Town Board
reconvened into open session. No action
was taken during the closed session. A
motion made by Supervisor Husak, seconded by Baade to adjourn. A roll call vote was taken and the motion
carried unanimously.
